The petitioner seeks bail in Mahnar P.S. Case No. 228 of 2015, registered for the offences punishable under Sections 414 and 34 of the Indian Penal Code.

The police apprehended two persons namely Rohit Sah and Kundan Kumar and from whose possession two stolen motorcycles were recovered. Rohit Sah and Kundan Kumar are said to have disclosed that the petitioner is kingpin of the gang. They also disclosed name of Pappu from whose possession one stolen motorcycle was recovered but nothing has been recovered from possession of the petitioner.

Learned counsel for the petitioner submits that Kundan Kumar and Rohit Sah have already been enlarged on bail vide

Patna High Court Cr.Misc. No.39387 of 2016 (3) dt.24-11-2016 2/2 orders passed in Cr. Misc. No. 15022 of 2016 on 17.05.2016 and Cr. Misc. No. 13689 of 2016 on 21.04.2016 respectively. The petitioner is in jail since 10.05.2016 and the petitioner has already remained in jail for more than six months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Vaishali in Mahnar P.S. Case No. 228 of 2015. (Prabhat Kumar Jha, J.) KKSINHA/- U T
