Mr. Rajkishore Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 02-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hajipur Town P.S.Case No. 366 of 2017 registered under Sections 147, 148, 149, 307, 324, 341 and 506 of the Indian penal Code and 27 of the Arms Act. Allegation in brief is that informant's father objected Manish Sahni for not easing in the field upon which Manish Sahni along with other accused persons shot at her father in his stomach. He again shot at him causing injury in his buttock and this petitioner shot at him causing injury in his abdomen. Submission is that petitioner's name has not been disclosed as assailants by the injured, Shyam Babu Paswan in his statement given before the police, he has only named Manish Sahni and stated that it was Manish Sahni who had shot at him causing injury in his abdomen. Later on, informant's

Patna High Court Cr.Misc. No.31186 of 2018(4) dt.02-08-2018 2/2 uncle has also given statement before the police and in the fardbeyan he has not stated that this petitioner shot in the abdomen of his brother. Moreover, the petitioner has no criminal antecedent.

Whereas learned counsel appearing on behalf of the State also concedes that injured in his statement has not named the petitioner shooting at his abdomen.

Having considered the aforesaid facts and circumstances, as the accusation is specific against Manish Sahni, as per the statement of the injured, the petitioner, namely , Sunil Sahni, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S.
