====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 13-08-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Phulwaria P.S. Case No. 153 of 2017 registered for the offences punishable under Section 392 of Indian Penal Code.

Informant in his written complaint has stated that on 08.12.2017 at about 11:30 P.M. after closing his shop he was going to his house along with his father and brother, meanwhile three miscreants on one motorcycle came and over powered them on strength of pistol and they snatched his mobile, purse, Aadhaar card, PAN card, Election Id card and Rs. 500/-. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.32742 of 2018(4) dt.13-08-2018 2/2 he is innocent and he has been falsely implicated in this case. He runs a mobile repairing shop and from his shop two mobiles were recovered by the police which are said to be stolen. Petitioner has no criminal antecedent and the co-accused on whose confession petitioner has been arrested, has been granted regular bail by the court below itself. Petitioner is in custody since 11.03.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the sanctification of Sri Raghuveer Prasad learned J.M. 1st Class, Begusarai, in connection with Phulwaria P.S.
