JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 11-05-2015 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition. However, learned counsel appearing on behalf of the respondent nos.4 to 7, by referring to the averments made in the counter affidavit filed on behalf of Respondent No. 4 and 7, submits that the reliefs sought for on behalf of the petitioner are completely misconceived and cannot be granted. According to him, the petitioner while he was the Chairman of Rajapur PACCS got the amount sanctioned for construction of a godown. After withdrawing Rs.40,000/- he has neither constructed godown nor he has returned the money despite reminder letters/communication made to him. Therefore, he is now liable to be criminally prosecuted under the appropriate provision of law.

Be that as it may, since none is appearing on behalf of

Patna High Court CWJC No.6856 of 2011 (2) dt.11-05-2015 the petitioner, the writ petition stands dismissed for want of prosecution.
