JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Majorganj P.S. Case No.159/16 for the offence under Section 302/34 of the I.P.C. and Section 27 of the Arms Act.

As per the allegation the petitioner including other co-accused persons are said to have fired upon the deceased. It is submitted that the petitioner has no criminal antecedent. He has not been named in the F.I.R. It is further submitted that neither any thing has been recovered from his possession nor he has been put on test identification parade. It is further submitted that one of the co-accused, Sudhir Kumar Singh @Munna Singh, having similar allegation has already been

Patna High Court Cr.Misc. No.49360 of 2016 (3) dt.10-01-2017 2/2 extended the privilege of bail vide Cr.Misc. No.51010 of 2016 on 22.12.2016.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Sitamarhi, in Majorganj P.S. Case No.159/16.
