The petitioner seeks regular bail in Industrial Area P.S. Case No.95 of 2017 for the offence under Sections 272, 273, 34 of I.P.C. and Section 30(a) and 41(i) of BihaR Excise Amendment Act.
Allegation as per the F.I.R. against the petitioner is of recovery of 40 Cartoons each contained 45 bottles each of 200 ml.. Submission of the learned counsel for the Petitioner is that he has falsely been implicated in this case and now he is in custody for 1 1⁄2 month.
Heard learned A.P.P. also who opposed the prayer for bail on the ground that the petitioner was earlier made an accused in such type of case in Cr.Misc. No.33/17 itself.
Patna High Court Cr.Misc. No.39231 of 2017 (2) dt.21-08-2017 2/2 Having heard both sides and in view of the fact that he has criminal antecedent, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and conclude within a period of four months from the date of receipt of a copy of this order, If the trail is not concluded within the stipulated period, the petitioner may renew his prayer for bail.
