====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-05-2016 Heard the learned counsel, Mr. Tribhuwan Narayan, for the petitioner.

By the order dated 29.05.2015, the learned Principal Judge, Family Court, Kaimur at Bhabhua directed the petitioner to pay Rs.4000/- only as maintenance under Section 24 of the Hindu Marriage Act in Matrimonial case No.27 / 375 of 2014. Perused the order passed by the Court below. It appears from the order that whatever point is being raised before this Court in this writ application were argued before the Court below and thereafter considering the facts and circumstances of the case, the Court below has directed the petitioner to pay interim maintenance of Rs.4000/- only.

Considering the day to day expenses in these days, in my opinion, the order passed by the Court below granting only Rs.4000/- cannot be said to be arbitrary or is excessive.

Patna High Court CWJC No.12533 of 2015 (2) dt.04-05-2016 2/2 Therefore, in supervisory jurisdiction, this Court cannot hold Panchayati and fix another quantum of the maintenance. Therefore, this writ application is dismissed. (Mungeshwar Sahoo, J) Sanjeev/- U
