The petitioner is languishing in custody for the offences punishable under Sections 363/366A/34 of the Indian Penal Code.

The petitioner allegedly kidnapped to the minor sister of his wife. The victim in her statement under Section 164 Cr.P.C. stated that in fact the petitioner had induced her to go to see his ailing father but took her to Delhi and thereafter Uttarkashi and stayed there for 5 to 8 days respectively. However, she did not allege anything against the petitioner. The parties have compromised the case. The petitioner is in custody since 19.11.2019.

No.38593 of 2020(3) dt.25-03-2021 2/2 Considering the fact that the victim never made any protest while travelling along with the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sathi P.S. Case No.109 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
