JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and the State. The petitioners seeks bail in a case registered under Sections 406, 419 and 420 of the Indian Penal Code. As per prosecution case, the petitioners are said to have taken Rs. 1,50,000/- from the informant on assurance that they will provide certificate of A.N.M. and job to his wife but they have not provided service to his wife and also did not return the money.
Learned counsel for the petitioners has submitted the petitioners have falsely been implicated in this case. The petitioners have never demanded Rs.1,50,000/- from the informant. However, they have paid the aforesaid money to the informant. In the impugned order it has also been mentioned that the informant has received the aforesaid money from the
Patna High Court Cr.Misc. No.33999 of 2017 (2) dt.20-07-2017 2/2 petitioners. The petitioners are in custody since 25.05.2017. Having considered the facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramanj, Rohtas in connection with Nasriganj P.S.Case No. 98 of 2017.
