In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 595 of 2016 for the offences punishable under sections 420, 467, 468, 471 and 34 of the I.P.C.
Allegedly, the petitioner and other co-accused being in collusion and conspiracy created forged sale deed with respect to the land of the informant.
Submission is of false implication, the petitioner is agnate of the informant, other co-accused, namely, Shivnath Yadav, Antu Yadav and Ramakant Yadav have been allowed pre-
Patna High Court Cr.Misc. No.34994 of 2017 (2) dt.10-08-2017 2/2 arrest bail vide Cr. Misc. No. 13465 of 2017 by order dated 02.05.2017, vide Annexure-2, and as such the petitioner also deserves sympathetic consideration.
The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Bettiah, West Champaran in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
