Petitioner is languishing in custody since 29.06.2016 in connection with Adhaura P.S. Case No. 43 of 2016 for the offences punishable under Section 302/34 of the Indian Penal Code.
The petitioner is not named in the F.I.R. The F.I.R. named accused Laxman Sah has already been allowed bail by another Bench of this Court in Cr. Misc. No.38409 of 2016 on 04.10.2016.
Submission is that only material against the petitioner is his confessional statement before the police in pursuance whereof a tangi, the alleged weapon used in the commission of occurrence, was recovered.
Patna High Court Cr.Misc. No.52683 of 2016 (2) dt.07-12-2016 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua, Kaimur/Successor Court, in connection with Adhaura P.S. Case No.43 of 2016.
