Mr. Shyameshwar Dayal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 11-07-2025 Heard Mr. Dewendra Narayan Singh, learned counsel for the petitioner and Mr. Shyameshwar Dayal, learned APP for the State.
2. Petitioner seeks regular bail in connection with Nayagaon P.S. Case No. 43 of 2025 dated 06.03.2025 registered for the offences punishable under Sections 25(1B)(a), 26 and 35 of the Arms Act.
3. The main submissions advanced by the petitioner's counsel are that the petitioner is a young person having fair and clean antecedent, though the instant matter relates to the recovery of foreign made pistol as well as live cartridges from the possession of this petitioner but he has been punished sufficiently as he has been languishing in jail since 06.03.2025 and against him, the investigation has been completed and all
Patna High Court CR. MISC. No.42522 of 2025(2) dt.11-07-2025 2/2 the alleged offences are triable by the court of First Class Magistrate.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
5. Heard both the sides and perused the relevant materials. Though the instant matter relates to the recovery of firearms from the possession of this petitioner but considering his fair and clean antecedent, his young age and completion of investigation against him and also, the fact that most of the material witnesses of the prosecution are police personnel, in my opinion, a lenient approach can be taken in respect of petitioner's prayer for bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Nayagaon P.S. Case No. 43 of 2025. (Shailendra Singh, J) maynaz/- U T
