JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the learned counsel for the State.

The allegation against the petitioner is of kidnapping the victim girl.

It has been submitted on behalf of the petitioner that the victim girl has been recovered and she has made statement under Section 164 Cr.P.C. but there is nothing about her sexual harassment by the petitioner. There is love affairs between the petitioner and the victim girl. The victim girl was examined by the Medical Board and she has been found to be between 18 - 19 years old.

Patna High Court Cr.Misc. No.49410 of 2016 (3) dt.14-12-2016 2/2 The petitioner is in custody since 26.09.2016. It has also been submitted on behalf of the petitioner that co-accused Pappu Sah has been granted bail by the Bench of Hon'ble Court vide order dated 12.2.2016 passed in Cr. Misc. No.56390 of 2015.

Having heard both sides as well as the facts as stated above, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mrs. Anju Singh, Sub Judge-IXth cumACJM, Muzaffarpur in connection with Sivai Patti P.S.Case No.93 of 2015.
