JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 04-09-2023 Heard Mr. Manish Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Kameshwar Pd. Gupta and Mr. Satya Vrat, learned counsels appearing on behalf of the State.

2. Learned counsel appearing on behalf of the petitioner submits that petitioner had retired on 31.03.2021 after completing age of 60 years from the post of Panchayat Sachiv. The petitioner is aggrieved for non-payment of retiral benefits including pension, which is payable to the Panchayat Sachiv. The petitioner for

Patna High Court CWJC No.9617 of 2023 dt.04-09-2023 2/3 redressal of his grievance, as prayed for in the present writ petition, seeks to file detail representation before the District Magistrate-Cum-Collector, Siwan.

3. The District Magistrate-Cum-Collector, Siwan, is directed to call for the service records relating to the petitioner from the Block Development Officer, Guthni, Siwan as well as the Block Development Officer, Darouli, Siwan.

4. The Block Development Officer, Guthni, Siwan as well as the Block Development Officer, Darouli, Siwan, respondent nos. 5 and 6 respectively are directed to personally produce the service records relating to the petitioner before the District Magistrate-Cum-Collector, Siwan within a period of one week from the date of passing of this order.

5. The District Magistrate-Cum-Collector, Siwan is directed to take final decision with respect to payment of retiral dues to the petitioner including the fixation of pension within a period of four weeks from the date of passing of this order in accordance with law.

6. The petitioner, if so advised, may also file detail representation before the District Magistrate-Cum-Collector, Siwan for facilitating the payment of retiral dues to the petitioner, as claimed for in the present writ petition.

7. In case, the concerned authorities deliberately still deny payment of retiral dues to the petitioner, the petitioner is at liberty to take appropriate legal action against the concerned respondents.

8. With the above observation and direction the writ petition stands disposed of.
