2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Nathnagar P.S. Case No. 171 of 2024, registered for the offence punishable under Section 302 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 23.10.2024 passed in Cr. Misc. No. 75099 of 2024.

4. Learned counsel for the petitioner submits that the petitioner in custody since 15.04.2024 and out of six witnesses, five witnesses have been been examined and the I.O. is not being examined.

5. Considering the fact that the petitioner is the

Patna High Court CR. MISC. No.42594 of 2025(2) dt.25-07-2025 2/2 assailant of the deceased, I am not inclined to grant bail to the petitioner.

6. Accordingly, the application stands dismissed.

7. The Senior Superintendent of Police, Bhagalpur is directed to ensure the examination of the I.O. in the trial.

8. Let a copy of this order be communicated to the Senior Superintendent of Police, Bhagalpur forthwith through FAX or e-mail for its compliance.
