The petitioner has preferred this application for grant of regular bail in a case registered under sections 414, 420, 467, 468, 471 and 120B of the Indian Penal Code, sections 25(1-B) (a), 26 and 35 of the Arms Act and sections 20(b)(ii)(C) of the NDPS Act.

As per the prosecution case, two live cartridges and objectionable pamphlets were recovered from the possession of the petitioner. Drugs was recovered from possession of the coaccused. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reason. No incriminating article has been recovered

Patna High Court CR. MISC. No.51915 of 2021(2) dt.25-02-2022 2/2 from his possession. He is in custody since 2.6.2021 and has no criminal antecedent. Investigation in the case has concluded. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than 8 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with N.D.P.S. Case no. 43 of 2021 (arising out of Motihari Muffasil P.S. Case no. 278 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge / Special Judge, Motihari, District East Champaran.
