JUSTICE RAKESH KUMAR ORAL ORDER 05-02-2016 Heard Sri Sunil Kumar Thakur, learned counsel for the petitioner, learned AC to GP-1 as well as Sri Ramyash Singh, learned counsel for the Respondent no.6/ Accountant General, Bihar.

The petitioner, who superannuated with effect from 31.10.2013, while functioning as Headmaster of Primary School, Sarhad Madho, Patori in the district of Samastipur on Matric Trained Pay Scale, has approached this Court, invoking its writ jurisdiction, with a prayer to direct the Respondents to make payment of G.P.F. amount, Group Insurance, unutilized leave salary besides salary for one month i.e. for the month of September, 2010.

Patna High Court CWJC No.19684 of 2014 (2) dt.05-02-2016 2/2 Instead of adjourning the case for asking the Respondents to file counter affidavit, the Court proposes to dispose of the writ petition granting liberty to the petitioner to file a detailed representation before Respondent no.4/ District Programme Officer( Establishment ), Samastipur regarding claim raised in the present writ petition. If such representation is filed with supporting documents within a period of six weeks from today, Respondent no.4 is required to examine the same and pass appropriate order. If there is no hurdle, he will pass order for clearing all the retiral dues of the petitioner within a period of three months from the date of filing of such representation. With above observation and direction, the writ petition stands disposed of.
