The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 30(d) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on a raid being conducted, 3 litres of country liquor and 300 litres of Mahua solution was recovered from the place of occurrence. The accused persons escaped. The petitioner was identified by the Choukidar amongst the accused persons who had managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has no concern with the seized liquor, Mahua solution or the place of recovery. The cause of his

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot, he having remained in custody for 9 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sirdala P.S. Case no.221 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
