Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and 47A of the Excise Act. It is alleged that 8800 liters of spirit were recovered from the truck. When the driver and cleaner apprehended, they disclosed the name of co-accused who escaped from the seen as petitioner.

It is submitted by the learned counsel for the petitioner that recovery cannot be treated from the possession of the petitioner and petitioner is not connected with the seized spirit or the truck in question. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.36313 of 2015 (2) dt.08-09-2015 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Ishuapur P.S. Case No. 52 of 2015, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.

With the above observation this application is disposed of.
