NILU AGRAWAL ORAL ORDER 06-11-2017 Heard learned counsel for the petitioner, learned counsel for opposite party no. 2 and learned APP for the State. In pursuance to the order dated 13.10.2017 both the petitioner and opposite party no. 2 (husband and wife) are personally present. The matter was earlier referred to the Mediation and Conciliation Centre, Patna High Court as opposite party no. 2 Seema Devi had lodged a case against the petitioner that she was married to the petitioner 11 years back and has two daughters out of the wedlock and her husband and mother-in-law are torturing and threatening her that she would be killed. The Mediator has submitted a report wherein both parties have compromised but again opposite party no. 2 stated

Patna High Court Cr.Misc. No.31161 of 2017 (4) dt.06-11-2017 2/2 that the petitioner is not complying with the terms and conditions of compromise.

Counsel for opposite party no. 2 submits that the education expenses and expenses of herself and the daughters are not being given by the petitioner in spite of settlement before the Mediator.

Today, the petitioner agrees to give maintenance of Rs. 6,000/- per month to opposite party no. 2, which he would deposit by 15th of every month in the Bank account furnished by opposite party no. 2. Opposite party no. 2 will be allowed to live in the matrimonial house where she is residing presently without any coercion. If the petitioner fails to make payment of Rs. 6,000/- per month and if any complaint is lodged of ill-treatment, the opposite party no. 2 will file an application before this Court, which will be heard on its own merit.

Provisional bail granted to the petitioner under order dated 12.07.2017 in connection with Danapur P.S. Case No. 200 of 2017, pending in the court of learned A.C.J.M., Danapur, Patna, is hereby confirmed.
