The petitioner is languishing in custody in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged against the petitioner that he has stolen away batteries and 20 litres of diesel from the truck of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The

Patna High Court CR. MISC. No.42536 of 2023(2) dt.28-07-2023 2/2 petitioner was not apprehended from the spot. The informant is not the eye witness to the occurrence. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 01.05.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Barh, Patna in connection with Mokama P.S. Case No. 142 of 2023.
