JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2023 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Brahampur (Nainijore) P.S. Case No. 14 of 2022 for the offence registered under Sections 304(B), 201/34 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner herein, who is the husband of the deceased victim lady, having tortured the sister of the informant and killed her on account of non-fulfilment of the demand for dowry.
The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, is having a clean antecedent and he is languishing in custody since 02.06.2022. Lastly, the learned counsel for the petitioner has submitted that the

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also having perused the impugned order dated 30.06.2022, this Court finds that not only the deceased victim lady was killed by the accused persons including the petitioner herein but her dead body was also disposed off hurriedly with a view to wipe out the evidence, hence, considering the fact that the petitioner is the husband of the deceased victim lady and supposedly, the main accused in the present case, I am not inclined to grant bail to the petitioner, hence, the present petition stands dismissed.
