JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 This application is for grant of bail in connection with Siwan Mufassil P.S. Case No. 111 of 2017 registered for the offences under section(s) 413 and 414 of the Indian Penal Code. Allegation against the petitioner is that one stolen motor cycle has been recovered from his possession. Submission of the learned counsel for the petitioner is that nothing is available on record to show that motor cycle was stolen and the petitioner is in custody for three months. Heard learned Additional Public Prosecutor also. Learned Additional Public Prosecutor opposes the prayer of bail on the ground that there is an allegation as per the FIR as well as the fact that he is in custody in three others cases and that too of the similar type.
Patna High Court Cr.Misc. No.31192 of 2017 (2) dt.13-07-2017 2/2 Having heard both sides and in view of the allegation made in the FIR, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed. However, the petitioner may renew his prayer for bail after framing of charge in this case before the Court below and the Court below will examine the materials available on record and at that time, will pass an appropriate order without being prejudiced by the order of this Court.
