1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case and is aged about 70 years. It is further submitted that specific allegation with regard to murder is not against this petitioner rather the same is against Santosh Rai who is son of this petitioner. It is next submitted that petitioner is in custody since 19.03.2023. It is also submitted that a person who has remained a person with clean antecedent till the age of 70 years, all of a sudden came to be implicated in a case of murder based on general and omnibus allegation. Patna High Court CR. MISC. No.45025 of 2024(2) dt.05-07-2024 2/2 further submitted that Nandu Ray and Munna Kumar had approached this Court seeking regular bail by filing Cr. Misc. No. 12058 of 2024 and the same was allowed by an order dated 06.03.2024.
4. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
5. Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marhowrah (Gaura O.P.)
