JUSTICE PRABHAT KUMAR JHA ORAL ORDER 06-09-2018 Heard Mr. Krishna Prasad Singh, the learned senior counsel appearing on behalf of the petitioner, Sonu Kumar and the learned Additional Public Prosecutor for the State. The petitioner seeks bail in Sessions Trial No.283 of 2017, arising out of Siwan Town P.S. Case No.311 of 2013 registered under Sections 302/34 and 120(B) of the Indian Penal Code.

The learned senior counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 28.04.2017, passed in Cr. Misc. No.12160 of 2017 but the trial has not yet been concluded although there was direction to conclude the trial within nine months. A report was called for and now the learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Siwan reported that

Patna High Court Cr.Misc. No.28779 of 2018(3) dt.06-09-2018 2/2 the prosecution evidence has been closed and the case is posted for argument.

Considering the fact aforesaid that the case is posted for argument, I am not inclined to enlarge the bail on bial. Accordingly, the prayer for bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
