The petitioner seeks bail in Special Case No. 4477/2019, arising out of Fatuha P.S. Case No. 289/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner has submitted that there is no recovery of illicit liquor from conscious possession of this petitioner. Petitioner has no concern with the alleged recovered liquor.
As per written report, on the basis of statement given by other co-accused, house of father of this petitioner was raided by the police. The police recovered 110 pieces of Beer of 500ml kept in the refrigerator of the father of petitioner.
Patna High Court CR. MISC. No.38799 of 2019(2) dt.01-07-2019 2/2 Petitioner is in custody since 08.05.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna, in connection with Special Case No. 4477/2019, arising out of Fatuha P.S. Case No. 289/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
