JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-47A/57 of the Bihar Excise (Amendment) Act, 2016. Twenty one bottles of Indian made foreign liquor were recovered from possession of the petitioner, while he was alighting from a bus.

Submission on behalf of petitioner is that the petitioner was caught on mere suspicion and as a matter of fact, the persons, who were carrying the aforesaid liquor, had fled away seeing the police and moreover, the petitioner does not have any criminal antecedent who is languishing in jail custody since 18-072016.
