Petitioners seek regular bail in connection with Chakia P.S. Case No. 103/2021 registered for the offences
Patna High Court CR. MISC. No.51595 of 2021(3) dt.19-05-2022 2/3 punishable under Sections 364-A, 120-B and 34 of the Indian Penal Code 1860.
As per the First Information Report lodged on 30.4.2021 the informant has stated that at about 6:00 P.M. in the evening, his minor son, namely, Amritanshu Kumar @ Banti went missing, however, at about 8:30 P.M. the informant received call on his Mobile and the caller demanded a sum of Rs.30,00,000/- as ransom.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case on the basis of confessional statement of co-accused Vikash Kumar and Ramesh Ram and name of co-accused Vikas Kumar was disclosed by the victim after his recovery in his statement recorded under Section 164 Cr. P.C. Learned counsel further submits that the victim in his statement has stated that he can identify the other accused persons but no Test Identification Parade has been conducted as yet. The petitioners have got no criminal antecedents and they are in custody since 4.6.2021. The co-accused Upendra Sah whose name was also disclosed by the Co-accused Vikas Kumar has been granted anticipatory bail by this Court and co-accused Ramesh Ram whose name was also disclosed by Vikas has been granted bail by learned court below

Regards being had to the submission made by the parties and taking into consideration the materials on record and the fact that petitioners are in custody since 4.6.2021 and other co-accused persons having similar allegation have been granted bail by this Court as well as learned court below, I am inclined to grant regular bail to the petitioners.
Accordingly, let the petitioners, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chakia P.S. Case No. 103/2021.
