2. The petitioner seeks regular bail in connection with Bhagwanganj P.S. Case No. 78 of 2025 registered for the offence under Sections 126(2), 115(2), 82(1), 85, 109(1), 352, 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is accused of torturing his wife and getting re-married. The petitioner has one child from the first marriage.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 06.05.2025. He further submits

Patna High Court CR. MISC. No.39065 of 2025(2) dt.25-06-2025 2/2 that the petitioner is ready to pay the maintenance of Rs. 5,000/- per month for the maintenance of the informant and their child.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Masaurhi/concerned Court below in connection with Bhagwanganj P.S. Case No. 78 of 2025 subject to condition that:

(i). The petitioner will start paying monthly maintenance of Rs. 5,000/- to the wife and child beginning from the month of June 2025. The maintenance amount of Rs. 5,000/- shall be paid in the first week of every month.
