JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with P.S. Case No. Saharsa Sadar P.S. Case No. 125 of 2017, registered under Section 394 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. Further submission is that in course of investigation Md. Haider was apprehended by the Police, who confessed his guilt regarding committing of robbery along with Sikandar, Kishore Sharma, Khurshid, Firoz and Pramod and he also confessed that he sold one mobile to the petitioner No.2 and thereafter that mobile was recovered from petitioner no.1, who is brother-in-law of the petitioner

Patna High Court Cr.Misc. No.28808 of 2017 (2) dt.05-07-2017 2/2 No.2, except the purchasing of the robbed mobile by petitioner no.2 and handing over the same to petitioner No.1 nothing has been collected against the petitioners to show their involvement in the present case. Both the petitioners having no criminal antecedent and they are in custody since 22.04.2017. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S.
