ANJANA MISHRA ORAL ORDER 07-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Pipra P.S. Case No. 115 of 2015, registered for offences punishable under Sections 341, 342, 324, 307/34 and 302 of the Indian Penal Code.

Diary in the present case was called for which has since been received.

Learned counsel for the petitioners submits that save and except suspicion that the petitioners were having litigation regarding partition of their properties with that of the deceased, there is no further cogent material on record to implicate these

Patna High Court Cr.Misc. No.37468 of 2015 (3) dt.07-01-2016 2/3 petitioners. It is further submitted that in several paragraphs of the case diary, it has come that the deceased was a drunkard and had been indulging in taking lot of liquor as a result of which he fell down. He further submits that there are no eyewitness to the occurrence and the entire case is founded on mere suspicion. Considering the facts and circumstances and also that there is no further cogent material on record to indicate the involvement of these petitioners and also that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs.

Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S. Case No. 115 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
