2. In this case, the petitioner is seeking regular bail in connection with Excise Patna P.S. Case No. 1133 of 2024, registered for the offences punishable under Sections 30(a), 56(b) of Bihar Prohibition and Excise Act, 2016 and Amendment Act, 2018 and 2022.

3. As per allegation, on a secret information, the informant intercepted the vehicle of the petitioner and recovered 116.46 liters of foreign liquor from his car.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The alleged vehicle does not belong to the petitioner

Patna High Court CR. MISC. No.46946 of 2024(2) dt.10-07-2024 2/2 rather it belongs to one Sonu Kumar. The petitioner is a person of clean antecedent and he is under custody since 13.05.2024.

Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-III, Patna in connection with Excise Patna P.S. Case No. 1133 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) After release, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present one, his bail bond shall be cancelled.
