The petitioner seeks bail in connection with Ujiarpur P.S. Case No. 320 of 2024 instituted for the offence under Sections 137(2) & 96 of the Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, minor daughter of the informant went missing from his house and during search, it was discovered that petitioner has allegedly enticed her for

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02-12-2024. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that victim in her statement recorded under Section 183 of the BNSS, has very clearly stated that she has solemnized marriage with the petitioner at her own volition. It is next submitted that victim has refused for her medical examination.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Charge sheet has already been submitted in this case under Sections 137(2) & 96 of the Bharatiya Nyaya Sanhita, 2023 and Section 9 of the Prohibition of Child Marriage Act.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge-sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.39714 of 2025(3) dt.03-09-2025 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ujiarpur P.S. Case No. 320 of 2024.
