JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Tharthari P.S. Case No. 68 of 2016 registered under Sections 420, 406 and 120(B) of the Indian Penal Code.

It is alleged in the First Information Report that the petitioner being a rice miller failed to deposit 1770.69 quintal of custom milled rice in lieu of paddy delivered to him for milling by the Bihar State Food Corporation. It is further contended that there was an agreement between the parties and as per agreement it was for the Corporation to lift the custom milled rice and since it failed in lifting the same, it could not be returned. Patna High Court Cr.Misc. No.39742 of 2016 (2) dt.17-09-2016 2/2 that out of the alleged amount, the petitioner has already deposited Rs.8,30,000/- which would be evident from the First Information Report itself.

Learned counsel for the State has opposed the application for grant of bail to he petitioner. Regard being had to the nature of allegation, the petitioner above named who is in custody since 25th July, 2016, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Hilsa, Nalanda, in connection with Tharthari P.S. Case No. 68 of 2016.
