The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 30(c) and 30(d) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, the petitioner was caught manufacturing liquor.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The petitioner is in custody since 26.7.2021 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and in view of the fact that the petitioner was caught at the place of

Patna High Court CR. MISC. No.51446 of 2021(2) dt.24-02-2022 2/2 occurrence manufacturing liquor, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. In view of the fact that the petitioner has no criminal antecedent, liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody. (Partha Sarthy, J) Spd/- U T
