This is an application for bail in connection with Sessions Trial No. 226 of 2017, arising out of Mojahidpur (Babarganj) P.S.Case No. 221 of 2016 registered for the offences punishable under Sections 376 and 306 of the Indian Penal Code. Petitioner happens to be father of two deceased daughters and allegation against him is that he has also committed rape upon his daughters and for that they have committed suicide and there is also suicide note of his daughter.
Submission of learned counsel for the petitioner is that as a matter of fact his first daughter committed suicide in the house of one Doctor and second daughter also committed suicide there and petitioner has falsely been implicated without any material on
Patna High Court Cr.Misc. No.42174 of 2017 (4) dt.16-11-2017 2/2 record and he is in custody since 1.12.2016.
Heard learned APP also, who has opposed the prayer for bail stating that allegation is serious.
Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner. However, learned court below is directed to get the suicide note examined by FSL and once report of FSL is received in this case, the petitioner may renew his prayer for bail before the court below, which will be decided on the basis of materials available on record at that time.
