The petitioner seeks bail in Daudnagar P.S. Case No. 329 of 2021, registered for the offence punishable punishable under Sections 272, 273, 120(b)/34 of the Indian Penal Code and sections 30(a), 34 and 36 of the Bihar Prohibition and Excise Act, 2018.

399.5 litres of country made and foreign liquor has been recovered from Bolero vehicle and this petitioner was apprehended on the spot.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern

Patna High Court CR. MISC. No.51079 of 2021(2) dt.29-11-2021 2/2 with the seized liquor. Petitioner was simply a passersby and he is in custody since 21.06.2021. Investigation is complete. Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IInd-cum-Special Judge Excise, Aurangabad in connection with Daudnagar P.S. Case No. 329 of 2021.
