The petitioners seek bail in a case registered for offences under Sections 30 (A), 37(A), 37(B) and 56(E) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 183 litres of foreign liquor were allegedly recovered from two places and the petitioners were apprehended in drunken state. Petitioners claim that they are having clean antecedent and are in custody since 08.07.2017.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.39955 of 2017(2) dt.25-08-2017 2/2 case, the petitioners, above named are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-IV, Bhojpur at Ara in connection with Excise Case No. 2441 of 2017 arising out of Piro P.S. Case No. 164 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
