Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 324, 325, 326, 504, 34, 506 of the Indian Penal Code. It is alleged that petitioner was making some construction which was protested by the informant when accused persons threw chili power in the eye of the informant and his son and made assault to the informant and his son causing fracture injuries on the hand and cut injuries on the head of the informant and his son.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusations have been levelled. The accusation of assault is omnibus and general against five persons and the injury has

Patna High Court Cr.Misc. No.36689 of 2015 (2) dt.10-09-2015 2/2 been found to be simple. There is counter version of the occurrence and petitioner's side also received injuries. Moreover the petitioner is more than seventy years of age. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Maniyari P.S. Case No. 82 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Muzaffarpur.

With the observations above, the application stands disposed off.
