JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons assaulted the informant and others by means of Tanga, Daab, rod and Khanti due to which they sustained injuries and also took away cash of Rs. One lakh and five pieces of ornaments from the house of informant. It is submitted that allegation is general and omnibus in nature. Both parties are Pattidar and residing in the same house. There is land dispute between the parties and to save his neck from Jalalpur PS case No. 224/2020, which is earlier in point of time, this false case has been filed. Petitioner is

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Saran, Chapra in connection with Jalalpur PS case No. 226/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
