APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 04-02-2021 Heard the parties through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Special Case no. 54 of 2020 arising out of Bihta P.S. Case no. 263 of 2020 registered under sections 8(c), 21(c), 25 and 29 of the N.D.P.S. Act. As per allegation in the FIR, 105 grams of smack is stated to have been recovered from a plastic bag on the motorcycle.
On perusal of the materials on record it transpires that the alleged quantity of recovery of smack is below the commercial quantity. Charge sheet has been submitted in the case. The petitioner is in custody since 3.4.2020 and has no criminal antecedent. Further co-accused Suraj Kumar has been enlarged on bail vide order dated 14.9.2020 (Annexure 2) passed in Cr. Misc. no. 22450 of 2020.

Having heard learned counsel for the parties and taking into consideration the grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Special Case no. 54 of 2020 arising out of Bihta P.S. Case no. 263 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge XXIV, Patna.
