The petitioner seeks bail in a case registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant is said to have been killed by the petitioner by putting her set in ablaze.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case merely on suspicion. As a matter of fact, the petitioner denied the marriage with the deceased. The allegation levelled against the petitioner

Patna High Court CR. MISC. No.38050 of 2020(3) dt.05-03-2021 2/2 is not specific rather general and omnibus in nature. The chargesheet against the petitioner has already been submitted by the police on 28.10.2019. The petitioner has no criminal antecedent and has been languishing in custody since 28.01.2020.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, after framing of charge, and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Naubatpur P.S. Case No.414 of 2018.
