The petitioner seeks bail in a case instituted for the offences under Sections 188, 274 of I.P.C. and Sections 27(B) (ii)/28 of Drugs and Cosmetics Act.

Prosecution case, in short, is that the informant and other police officials raided the house of one Smt. Pappi Singh and recovered some drugs. The owner of said recovered drugs Anischal Kumar fled away and another owner Kundan Kumar Singh (petitioner) was caught red handed, who did not produce any paper regarding seized drugs.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.03.2019 and has got no criminal antecedent. Charge sheet/prosecution report has been submitted

Patna High Court CR. MISC. No.38766 of 2019(2) dt.27-06-2019 2/2 in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner denies recovery of medicines in question. There is no compliance of provisions of search and seizure.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Sitamarhi in connection with Punaura P.S. case No.60 of 2019.
