2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 498(A), 494/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
3. There is allegation of commission of torture and harassment due to non-fulfillment of demand of dowry.
4. It is submitted on behalf of the petitioners that these petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.45582 of 2023(2) dt.10-08-2023 2/2 case. Allegation is general and omnibus against these petitioners. They are separate in mess and property. Thrust of allegation is against husband of the informant.
5. Learned counsel for the informant oppose the bail petition and submits that specific allegation is against these petitioners and petitioner no . 1 has got three criminal antecedent.
6 Considering the aforesaid facts and circumstances of the case and the fact that thrust of accusation is against husband, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate No- VIII (ACJM-VIII) Motihari District- East Champaran in connection with Pakridayal P.S. Case No . 02 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
