JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Barharia (G.B. Nagar) P.S. Case No. 167 of 2015 for the offences instituted under Sections 341, 323 and 409/34 of the IPC. The prosecution story, in brief, is that the informant had given Rs. 1,00,000/- to the petitioner for giving Visa and Passport for his son about three months back but the petitioner even after taking the money did not give him Visa. It is further alleged that on asking for his money the petitioner assured that he will return the said money on 29.05.2015 and on the said the petitioner asked for money he was assaulted by four persons including the petitioner at Sikandarpur Masjid.

Patna High Court Cr.Misc. No.39437 of 2015 (2) dt.28-09-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is a case and counter case. It is admitted that there is land dispute between the parties. Both sides have sustained injuries. It is further submitted that the injury on the side of the petitioner has not been explained by the prosecution.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Barharia G.B. Nagar) P.S. Case No. 167 of 2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
