2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 325 ,384, 504, 506 and 34 of the Indian Penal Code .
3. As per the prosecution case , this petitioner alongwith other co-accused persons demanded Rs. Five lacs from the informant and on refusal co-accused Nilkamal assaulted him with iron rod due to which he sustained injury and fell down .
4. Learned counsel for the petitioner submits that specific accusation of assault is against other co-accused person . So far as as this petitioner is concerned, he is only alleged to be the member of mob. F.I.R., has been lodged after
Patna High Court CR. MISC. No.47245 of 2024(2) dt.13-08-2024 2/2 the delay of twenty days for which there is no plausible explanation which itself creates doubt over the entire prosecution case . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Clas Nawada in connection with Nardiganj P.S. case No. 04 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
