JUSTICE SUDHIR SINGH ORAL ORDER 18-01-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Amdabad P.S. case No.138 of 2013 instituted for the offence under Sections 302 and 120(B)/34 of the Indian Penal Code, pending in the court of learned A.D.J. 1st, Katihar.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with the direction to the trial court to conclude the trial preferably within a period of one year from the date of receipt of the order. In the light of the said direction the present bail application has been preferred on behalf of the petitioner.

A report was called for from the trial court regarding the stage of the case. It has been reported that out of fifteen charge

Patna High Court Cr.Misc. No.49005 of 2016 (3) dt.18-01-2017 2/2 sheeted witnesses ten prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six months.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to ensure that the trial is concluded within a period of six months from the date of receipt/production of a copy of this order. The District Magistrate, Katihar and the Superintendent of Police, Katihar are also directed to ensure that the remaining witnesses are produced on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
