2. The petitioner seeks regular bail in connection with Rahika P.S. Case No. 246 of 2023 registered for the offence under Sections 409, 420/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of defalcating Rs. 3,78,207.29/-.

4. Learned counsel for the petitioner submits that the petitioner without being any prejudice to his case and without accepting his guilt is ready to deposit the defalcated amount of Rs. 3,78,210/-. The petitioner is in custody since 09.04.2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.41255 of 2025(2) dt.09-07-2025 2/2 as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Madhubani/concerned Court below in connection with Rahika P.S. Case No. 246 of 2023 subject to the following conditions that:- (i). The petitioner is permitted to deposit the amount of Rs. 3,78,210/- within 12 months in 12 equal installments.

(ii). The petitioner shall be released on provisional bail after he deposits the first installment i.e., Rs. 31,517/- in the Court below. Rest of the installments shall be deposited by the petitioner within the next 11 months failing which the Court below will be at liberty to cancel the bail bonds of the petitioner.

(iii). After the entire amount is deposited, the provisional bail granted to the petitioner shall be confirmed by the Court below.
