The petitioners seek bail in a case initially registered under Sections 356, 379 of the Indian Penal Code and 27 of the Arms Act but subsequently Section 392 of the Indian Penal Code was also added.

Prosecution case in short is that the golden chain of mother of the informant and cash Rs. 10,000/- from the informant itself was snatched away by the accused persons.

It has been submitted on behalf of the petitioners that there the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.39268 of 2019(2) dt.27-06-2019 2/2 petitioners. The petitioners are in custody since 15-03-2019. Charge sheet has already been submitted. The petitioners are not named in the FIR. There is no recovery of any incriminating article from possession of the petitioners. The petitioners were not put on test identification parade.

On behalf of the State, it is submitted that the petitioners are not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakiya) P.S. Case No. 116 of 2019.
