This is an appeal filed under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Patna Atrocities) Act, (hereinafter in short referred to as the 'SC/ST Act') against the order dated 29.07.2021 passed by learned Special Judge SC/ST (POA) Act, Patna in connection with Rajeev Nagar P.S. Case No. 206 of 2021, registered under Sections 302/34 of the Indian Penal Code and Sections 3(2)(v) of the SC/ST Act, whereby the prayer for anticipatory bail of appellants has been rejected.

As per prosecution case, these appellants killed the

It is submitted that appellants have falsely been implicated in this case. As a matter of fact the deceased never worked in their house and while trying to commit theft he got electrocuted and died due to electrocution.

However, learned Spl. P.P. vehemently opposes the prayer for bail and submits that it has come during the course of investigation that deceased was working as domestic help in the house of appellants and his dead body was found near the house of appellants and death is caused due to electrocution. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the appellants on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
